I had never experienced such a traumatic and embarrassing moment. It was as devastating as I later discovered Hurricane Katrina to be 13 years later.<\/p>\n<p class=\"style1\"><strong>Personal History<\/strong><\/p>\n<p>Danielle was the ninth and youngest child in a two-parent family of hard working individuals.\u00a0 Her father, Emanuel Bernard was a cement finisher and president of the union he belonged to.\u00a0 Her mother, Barbara, worked at night for a bakery for 41 years until Hurricane Katrina which displaced her and the bakery.\u00a0 Barbara was one of 7 siblings and unlike Barbara, her sister, (aka Annie) took another route and became a petty drug dealer.<\/p>\n<figure id=\"attachment_604\" aria-describedby=\"caption-attachment-604\" style=\"width: 310px\" class=\"wp-caption alignright\"><a href=\"http:\/\/louisianajusticeinstitute.blogspot.com\/2011\/07\/danielle-metz-prisoner-of-us-drug-war.html\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-604 size-full\" src=\"http:\/\/www.candoclemency.com\/wp-content\/uploads\/2014\/10\/danielle_metz_photo.jpg\" alt=\"danielle_metz_photo\" width=\"310\" height=\"190\" srcset=\"https:\/\/sheryanne.com\/cando-new2\/wp-content\/uploads\/2014\/10\/danielle_metz_photo.jpg 310w, https:\/\/sheryanne.com\/cando-new2\/wp-content\/uploads\/2014\/10\/danielle_metz_photo-300x184.jpg 300w\" sizes=\"auto, (max-width: 310px) 100vw, 310px\" \/><\/a><figcaption id=\"caption-attachment-604\" class=\"wp-caption-text\">Click for Danielle&#8217;s page on &#8220;Louisiana Justice Institute&#8221;<\/figcaption><\/figure>\n<p>At 17, Danielle became pregnant by Carl, who was murdered when the baby was six months old.\u00a0 Emanuel wanted her to abort the child and although Danielle was ashamed that she had disappointed her family, she was determined to keep the baby and vowed to take good care of her child. Just before Carl died, Danielle had caught the eye of Glenn Metz, who told Danielle that he would some day marry a woman like her \u2013 he respected the fact that she was never in the clubs and was joined at the hip to her son, Carl Jr.\u00a0 After Carl Sr. died, Danielle became depressed and Glenn was there to console her.\u00a0 He promised to take care of Danielle and Carl Jr.\u00a0 He was 30 and Danielle was 18.<\/p>\n<p>As time went by, Annie became involved with Glenn and his business.\u00a0 Initially, Glenn did not involve Danielle in the drug business and was very controlling.\u00a0 He didn\u2019t like her going to her mother\u2019s house for more than an hour so Danielle made it a priority to be a good \u201chouse wife,\u201d cooking and caring for Carl Jr. and Glenn.\u00a0 After Danielle had a child with Glenn, they got married.\u00a0 It wasn\u2019t long before Glenn became abusive.\u00a0 He didn\u2019t like Danielle to have an opinion and would strike her if she disagreed with, or upset him.<\/p>\n<p>Glenn made Danielle feel as if she was getting a free ride because he paid all the bills and she didn\u2019t work, although he\u2019d never let her get a job.\u00a0 Danielle had some cosmetology schooling, so she would cut hair, in house, because he didn\u2019t like her leaving home, but that was the extent of her skills and\/or source of income, other than Glenn.<\/p>\n<p><strong>Nature of the Case:<\/strong><\/p>\n<p>Glenn made Danielle feel subservient and beholding because he paid the bills.\u00a0 After one abusive episode, to overcome the image that she did not contribute to the budget, she promised Glenn that she would help out any way he wished. He didn\u2019t say anything at the time, but later asked her to ride with her Aunt Annie to Houston.\u00a0\u00a0 Danielle did this two times, which ensnared her in the conspiracy.\u00a0 Also, at his request, Danielle collected some money from Western Union.<\/p>\n<p>Danielle never had an account in her name or a social security number.\u00a0 She was completely dependent on Glenn.\u00a0 In 1990 they moved to Las Vegas, which removed her from having access to her family.\u00a0 One day, they traveled to Los Angeles to see Danielle\u2019s sister, Adriane. While there, Glenn called Danielle into the bathroom and backhanded her, causing her nose to gush with blood, because she had said, \u201cso be it,\u201d to Glenn.\u00a0 He told her to not come out until there was no trace of blood.\u00a0 Adriane was so busy playing with the kids that she didn\u2019t notice anything wrong, until she saw Danielle, but Danielle just claimed to not feel well.<\/p>\n<p>While returning to Las Vegas, Danielle planned her escape. When Glenn left for the casino, Danielle left a note in the closet and took the kids to Pizza Hut. After pizza, they went to a hotel and stayed the night.\u00a0 The next day, before boarding a flight to New Orleans, Danielle called Glenn to tell him where she\u2019d left the car and that the keys were under the mat and that she was leaving him.<\/p>\n<p>In New Orleans, Barbara was happy to see her daughter.\u00a0 Glenn called constantly, begging her to come home, but she assured him it was over.\u00a0 Two months later, Danielle was indicted.<\/p>\n<p><strong>Details of the Case:<\/strong><\/p>\n<p>Danielle was cast into a gang of co-conspirators, most of whom she\u2019d never met and was charged with 4 counts.<\/p>\n<p>Count 1 \u2013 Conspiracy to possess with intent to distribute cocaine.<br \/>\nCount 3 \u2013 Continuing Criminal Enterprise \u201cCCE\u201d<br \/>\nCount 5 \u2013 Possession with intent to distribute cocaine hydrochloride.<br \/>\nCount 6 \u2013 Laundering of monetary instruments.<br \/>\nShe received a <span style=\"text-decoration: underline;\">TRIPLE LIFE SENTENCE.<\/span><br \/>\nOn 6\/27\/97 Count 1 was vacated.<\/p>\n<p>Throughout the entire \u201cPSR\u201d (pre-sentence report) Danielle is never linked to any violence or guns.\u00a0 The only count that mentions acts of violence is Count 1 and it was vacated from Danielle\u2019s sentence, but she did not benefit because she was held accountable for <span style=\"text-decoration: underline;\">all acts committed by her co-defendants<\/span> in 3 more Counts.\u00a0 When Count 1 was vacated, she was never brought back to court to contest the prejudicial impact Count 1 originally caused \u2013 based on the jury hearing about the violent acts committed by co-defendants.\u00a0 Vacating Count 1 left Danielle with TWO LIFE SENTENCES that she was never able to re-address &#8211; especially the prejudice suffered by being indicted with a group of co-defendants, some of who committed murder. Nor did she get the benefit of several changes in the law, including relevant conduct.<\/p>\n<figure id=\"attachment_785\" aria-describedby=\"caption-attachment-785\" style=\"width: 474px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-785\" src=\"http:\/\/www.candoclemency.com\/wp-content\/uploads\/2014\/11\/Amy_Danielle_WH-1024x768.jpg\" alt=\"Amy takes Danielle Metz to the White House - 2014\" width=\"474\" height=\"354\" \/><figcaption id=\"caption-attachment-785\" class=\"wp-caption-text\">Amy takes Danielle Metz to the White House &#8211; 2014<\/figcaption><\/figure>\n<p>The key witness against Danielle was her Aunt Annie, who had much to gain by cooperating.\u00a0 Unlike Danielle, Annie already had prior convictions for drug dealing. The feds entrapped Annie in a separate case and offered her a plea if she would testify against Glenn and Danielle in this case.\u00a0 Because of Annie\u2019s testimony, Danielle was branded an \u201corganizer.\u201d Although Danielle rode with Annie on two occasions to Houston in a vehicle that contained money &#8211; and one time, they brought drugs back, Annie was doing this long before Danielle rode with her, so she was not being organized or directed by Danielle.\u00a0 At best, Danielle was a companion so Annie didn\u2019t have to make the drive alone.<\/p>\n<p>Barbara Bernard retained a lawyer that Danielle hired, but later learned he had never tried a criminal case \u2013 and did not know federal law.\u00a0 He only visited her one time in jail and that was the day before the trial.\u00a0 He told Danielle that Annie was going to be the key witness against her.<\/p>\n<p>As an aside, the PSR casts doubt on Danielle\u2019s assertion that she had no bank account or viable assets.\u00a0 According to the DEA, money was seized from Barbara Bernard, Danielle and Glennisha Metz\u2019s accounts \u2013 alluding that these were drug proceeds that Danielle was hiding.\u00a0 Barbara contested the seizure and eventually won, because the money was verifiable proceeds from her bakery earnings and she had opened joint accounts for Danielle and Glennisha to save for their future. This, however, was not established until after Danielle\u2019s conviction.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 1993, at the age of 26, Danielle Metz was sentenced to serve three life sentences plus twenty years for conspiracy to distribute cocaine. It was her first conviction. Evidence suggests that Danielle never knew that her husband, Glenn, was involved in drugs.
